Cybrec Standard Plan Terms of Service

Welcome to Cybrec (“Cybrec,” “we,” “us,” or “our”). This Terms & Conditions Agreement (“Agreement”) is a legally binding contract between you, the user, whether personally or on behalf of an entity (“you” or “your”), and Cybrec regarding your access to and use of the Cybrec website at https://www.cybrec.com (“Website”) and any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Service”).

PLEASE READ THE FOLLOWING TERMS CAREFULLY:

BY ACCESSING, DOWNLOADING, INSTALLING, OR OTHERWISE USING THE SERVICE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND, AS A CONDITION TO YOUR USE OF THE SERVICE, YOU AGREE TO BE BOUND BY THE FOLLOWING TERMS AND CONDITIONS, INCLUDING CYBREC’S PRIVACY POLICY (AVAILABLE AT HTTPS://WWW.CYBREC.COM/PRIVACY-POLICY). IF YOU ARE NOT ELIGIBLE OR DO NOT AGREE TO THIS AGREEMENT, THEN YOU MAY NOT USE THE SERVICE.

1. Service Overview

1.1 Platform Description: Cybrec provides an IT security learning platform that includes access to video courses, quizzes, virtual labs, articles, and related services. While Cybrec is responsible for curating and providing access to these resources, it is important to note that the platform hosting the video content and quizzes is operated by a third-party provider (“Third-Party Platform”) under a Software as a Service (SaaS) model. Cybrec facilitates access to the Third-Party Platform but does not own or control it.

1.2 Third-Party Platform Acknowledgement: By using Cybrec’s services, you acknowledge and agree that certain components of the Service, specifically video content and quizzes, are hosted on a Third-Party Platform. Cybrec shall not be liable for any disruptions, technical issues, or data loss that may occur on the Third-Party Platform. However, Cybrec commits to making reasonable efforts to ensure the Third-Party Platform maintains high standards of service and data protection.

2. Order Process

2.1 Subscription and Access: Access to specific services or content on our platform, including those hosted on the Third-Party Platform, is provided according to orders that are placed by you or on your behalf and are accepted by us. Each order, once accepted, forms a part of this agreement and grants you a right to use the services in accordance with these terms.

2.2 Third-Party Terms: Use of the Third-Party Platform may be subject to additional terms and conditions imposed by the third-party provider. You are responsible for reviewing and complying with any such terms. Cybrec will provide, whenever possible, prior notice of any significant terms and conditions or changes thereto that might affect your use of the Service.

3. Use of the Service

2.1 Access Rights: Subject to this Agreement, Cybrec grants you a non-transferable, non-exclusive, right to access and use the Service for your personal, non-commercial purposes.

2.2 User Restrictions: You agree not to misuse the Service. This includes, but is not limited to, refraining from trying to access the Service through unauthorized means, not disrupting the Service or servers, and not using the Service to store or transmit malicious code.

4. User Obligations

You agree to comply with all local, state, national, and international laws and regulations applicable to your use of the Service. You also agree to provide accurate and complete information about yourself as required in the registration process and to keep this information up to date.

5. Fees and Payment

Fees for the Service are set forth on our Website and must be paid in accordance with our payment terms. Failure to timely pay any fees may result in suspension or termination of your access to the Service.

6. Subscription Terms and Cancellation Policy

6.1 Non-Refundable Subscription: Our subscriptions to access Cybrec’s IT security learning platform, including video content and quizzes hosted on the Third-Party Platform, are billed in advance on a recurring basis and are non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made.

6.2 Cancellation Policy: While we do not offer refunds, you have the flexibility to cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of your current billing cycle. This policy ensures that you retain access to Cybrec’s IT security learning platform for the duration of the period you have already paid for.

7. Term and Termination

This Agreement commences on the date you first use the Service and continues until all subscriptions issued under this Agreement have expired or have been terminated.

8. Intellectual Property Rights

All rights, title, and interest in the Service and its content, features, and functionality (including all information, software, text, displays, images, video, and audio) are owned by Cybrec.

9. Confidentiality

You agree to maintain the confidentiality of any confidential information provided by Cybrec in connection with your use of the Service.

10. Warranties and Disclaimers

The Service is provided “as is” and Cybrec specifically disclaims all warranties, whether express, implied, statutory, or otherwise. Cybrec does not warrant that the Service will meet your requirements or that its operation will be uninterrupted or error-free.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cybrec, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of this Agreement or your use of the Service.

12. Limitation of Liability

To the fullest extent permitted by law, in no event will Cybrec, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Service, any websites linked to it, any content on the Service, including any direct, indirect, special, incidental, consequential, or punitive damages, including but not limited to, personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract, or otherwise, even if foreseeable.

13. Modifications to the Service and Prices

13.1 Cybrec reserves the right at any time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.

13.2 Prices of all Services, including but not limited to monthly subscription plan fees to the Service, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the Cybrec Site (cybrec.com) or the Service itself.

14. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Poland, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the courts located in Piotrków Trybunalski, Poland, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

15. Feedback

We welcome any comment, question, and communication at support@cybrec.com. Any feedback you provide regarding the Service shall be deemed non-confidential. Cybrec shall be free to use such information on an unrestricted basis.

16. Assignment

You may not assign your rights or obligations under this Agreement to another party without the express written consent of Cybrec. Cybrec may assign its rights under this Agreement without condition.

17. Severability

If any provision of this Agreement is held to be unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from this Agreement and will not affect the validity and enforceability of any remaining provisions.

18. Waiver

The failure of Cybrec to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. Any waiver of any provision of this Agreement will be effective only if in writing and signed by Cybrec.

19. Entire Agreement

This Agreement constitutes the entire agreement between you and Cybrec regarding the Service, superseding any prior agreements between you and Cybrec (including, but not limited to, any prior versions of the Agreement).

Cybrec reserves the right, in its sole discretion, to change, modify, add, or remove all or part of this Agreement at any time, with or without notice.

By using the Service, you acknowledge that you have read these terms and conditions and agree to be bound by them.
